Do You Need a Permit To Build a Backyard Deck?

You’ll need a permit to build a backyard deck with a design that’s more than 0.6m above grade. No permits are required to construct decking that’s to be installed lower than this threshold.

In general, you need a permit to build a deck when:

  • You’re building a brand-new deck higher than 0.6m above grade
  • You’re remodeling, replacing, or improving your existing decking system
  • You’re replacing parts of your deck structure, such as footings, posts, beams, joists, stairs, hardware, etc.
  • You’re building new stairs onto an existing decking system

Keep in mind that this permit and these rules apply to uncovered decks only. If you plan to build a covered deck, it’s considered an addition when the roof is attached to your house, and a permit that applies to home additions becomes necessary. If your covered deck’s roofing system doesn’t attach to your home, this structure is classified as an accessory residential building, and—depending on your construction plans—you may need a separate permit.
